International student are no longer allowed to bring dependants with them
Effective January 2024, new regulations for the UK dependent visa will be implemented. International students will no longer be allowed to bring dependents to the UK unless they are enrolled in a PhD program or a postgraduate research program. Furthermore, care workers and senior care workers will no longer be permitted to bring dependents, effective March 11, 2024.
Who can apply for a dependant visa?
You may apply for a dependent visa if you are a dependent of an individual holding an eligible UK work visa, student visa, business visa, or ancestry visa. Please note that not all work or student visa holders are eligible to bring their dependents to the UK. If you are unsure about your eligibility, we recommend consulting with our legal team for clarification. A ‘dependent’ refers to a partner/spouse or child of the primary visa holder.
Partners must be either legally married or in a civil partnership with the primary visa holder, or they must have cohabitated for a minimum of two years.
To apply for a child dependent visa, children must be under 18 years of age, or if 16 years or older, they must be financially dependent on the primary visa holder. Financial dependency implies that they:
- Are not living an independent life (i.e., not married, in a civil
partnership, or have children) - Reside with the primary visa holder (unless they attend boarding school or university)
- Receive financial support from the primary visa holder
In addition to dependent visas for children and partners, it is possible to sponsor close family members to the UK if the UK resident has indefinite leave to remain (ILR) or UK citizenship and meets the Adult Dependent Relative visa requirements.
